Despite new improvements in vehicle technology, such as adaptive headlights, backup cameras and pre-crash warning systems, car accidents still happen at a high rate. The nonprofit National Safety Council estimates in a report issued in March of 2021 that 42,060 people died in vehicle crashes in 2020, which is an 8% increase over 2019 and the first jump in four years.

COMMON REASONS OF CAR ACCIDENTS IN CALIFORNIA

Whether a minor or severe, auto accidents can drastically change a person’s life. They can result in a loss of wages, pain and suffering, medical bills, permanent disabilities and other long lasting symptoms.  Individuals involved in auto accidents have a legal right to compensation for their injuries and damages.  Some of the common causes of car accidents are: distracted driving, driving while intoxicated, speeding, running a red light, reckless driving, fatigue, weather conditions, vehicle defects.

DISTRACTED DRIVING AND CAR ACCIDENTS

Distracted driving occurs when the attention of the driver is diverted from driving, for reasons such as, texting on the phone, eating, talking to people in your vehicle, operating the stereo or the navigation system. Anything that takes your attention away from safely driving your vehicle is unsafe and risky.  Texting is the most common distraction when operating an automobile. That quick text that you think is safe to type and send may cause a car crash, injuring yourself and others.  Sending or reading a text takes your eyes off the road for 5 seconds. At about 55 mph, that’s like driving the length of an entire football field with your eyes closed.

DRUNK DRIVING AND AUTO ACCIDENTS

As alcohol levels rise in a person’s system, the negative effects on the central nervous system increase. A person’s alcohol level is measured by the weight of the alcohol in a certain volume of blood. This is called Blood Alcohol Concentration, or BAC. At a BAC of .08 grams of alcohol per deciliter (g/dL) of blood, crash risk increases exponentially. Because of this risk, it’s illegal in all 50 states, the District of Columbia and Puerto Rico to drive with a BAC of .08 or higher, except in Utah where the BAC limit is .05.  Nonetheless, even a small amount of alcohol can affect driving ability and concentration of a motorist, since every person can have a different effect from an alcoholic beverage. For that reason, it is safer to take an Uber or Lyft instead of driving intoxicated that may result in a crash and injuries to yourself and other parties involved.

You also must know, that when you purchase auto insurance policies, there may be exclusions that you are not aware of.  Many insurance companies would deny liability coverage bodily injury or property damage intended by, or reasonably expected to result from, the willful, intentional or criminal acts or omissions of the responsible party (s). This means that your insurance company may deny coverage if you are involved in a car crash and were intoxicated at the time of the crash.

SPEEDING AND CAR ACCIDENTS

Speeding is a major cause in traffic deaths and injuries in Los Angeles California.  Driving at an excess speed reduces the amount of time the driver has to react in a dangerous situation in order to avoid a car accident.

If you are driving at 80 miles per hour, it would be much difficult to avoid a collision with a vehicle that has suddenly stopped due to traffic ahead.  Speeding also makes it more challenging for drivers to maintain control of their vehicle on curved roads.  A sudden loss of control may also occur in wet, icy, or high-wind conditions while operating an automobile at a relatively higher speeds.

CAR ACCIDENTS CAUSED BY RUNNING A RED LIGHT OR A STOP SIGN

Many drivers ignore their own safety and the safety of others, simply because they are in a hurry and are distracted while operating their vehicle – not realizing that they failed to stop at an intersection.  Majority of accidents where a driver speeds up to avoid stopping at a red light are severe and cause serious injuries to parties involved.   A typical accident that happens during a red light violation is a T-bone accident, where one car strikes the side of another car.  Some red light accidents end up being disputed by the parties involved.  For that reason, installing a dash board camera in your vehicle is essential to dodge unfair claim denials and reduced compensation from the responsible party’s insurance company.

CAR ACCIDENTS CAUSED BY RECKLESS DRIVING

When another driver operates his vehicle recklessly and as a result causes an accident and injuries to others, the victims may be entitled to file a civil claim for compensation.  Reckless driving also known as aggressive driving relates to the following violations:

  • Excessive speed
  • Unsafe lane changes
  • Passing on the right shoulder, outside of normal traffic lanes
  • Following too closely (tailgating)
  • Failure to obey traffic lights or signs

WHY CHOOSE ARATTA LAW FIRM?

At our firm, every injured client will be in direct contact with an attorney.  Many large corporate law firms end up transferring you to a case manager – you never speak to an attorney directly and your case becomes part of the mill.

At our firm, we do things different.  We pay close attention to every individual case, from the inception and throughout the process of the claim / lawsuit. Our diligence and attention to detail result in consistent higher settlements, which adds up to a higher compensation for you, the client.

ATTORNEY’S ABILITY TO NEGOTIATE

Even though you may have a solid personal injury claim, the skill and the attentiveness of your attorney can also considerably impact how much compensation you will receive for your injuries.  If your injury claim is negotiated by a case manager, assigned to your file at a firm, and not an attorney, your claim may end up settling for a lesser amount.  This is because adjusters know who they’re dealing with and how aggressive the firm is when settling injury cases.  Insurance adjuster also know who they can bully into accepting lower settlements.

An attorney’s ability to negotiate a settlement is, in many ways, the most important skill an attorney possesses. Lawyers who are effective negotiators know the importance of timing, preparation and strategy.  That being said, our firm recognizes the importance of precision, timing and subsequent results, which is the foundation of Aratta Law.  At our firm, nothing happens by luck but by great preparation and good strategy.
